On July 27, 2001,
the Office of Environmental Health Hazard Assessment (OEHHA) of
the California Environmental Protection Agency, lead agency for
the implementation of Proposition 65, proposed to reformat the list
of chemicals known to the state to cause reproductive toxicity into
a single list, ordered alphabetically by chemical, with the endpoint
of concern (developmental, female or male) for listing each chemical
clearly noted.
A public workshop was held on September 10, 2001 to receive input
on the proposal. Several comments were received supporting the proposal.
No comments were received opposing the proposal. Accordingly, OEHHA
is reformatting the list of chemicals known to the state to cause
reproductive toxicity into a single, alphabetical list. Reformatting
of the list is an administrative matter not subject to the Administrative
Procedure Act (Health and Safety Code Section 25249.8(e).) Therefore,
the reformatted list will be submitted as a "for print only"
package to the Office of Administrative Law. The reformatted reproductive
toxicity list is included with this notice. The format of the list
of chemicals known to the state to cause cancer will not change.
A comment was received that suggested that both the list of chemicals
known to cause cancer and the list of chemicals known to cause reproductive
toxicity be combined into one single list. After considering the
suggestion, it was concluded that this would likely foster confusion
for those using the list. Numerous chemicals are included on both
the cancer and reproductive toxicity lists, but the dates of addition
of a chemical to the two lists are frequently different. Also, the
levels and periods of exposure at which the warning requirement
of the statute apply to a chemical on both lists are generally different
for each form of toxicity, as is the level of discharge triggering
the discharge prohibition. Maintaining two separate lists will reduce
the possibility of confusion over applicable dates and exposure
or discharge levels for chemicals listed under Proposition 65. However,
as a service to those who would find it useful, we will, in addition
to the reformatted reproductive toxicity list, post a single, combined
(cancer and reproductive toxicity) list on the OEHHA Web site at
www.oehha.ca.gov.
