The Safe Drinking Water and Toxic Enforcement Act
of 1986 (Proposition 65) requires the Governor to publish, and update
at least annually, a list of chemicals known to the State to cause
cancer or reproductive toxicity. The Office of Environmental Health
Hazard Assessment (OEHHA) is the lead agency for the implementation
of Proposition 65.
On February 9,
2001, OEHHA published a notice in the California Regulatory
Notice Register (CRNR) (Register 01, No. 6-Z) announcing its intent
to list bromate under Proposition 65 in accordance with the regulatory
criteria in Section 12306
of Title 22 of the California Code of Regulations. The publication
of the notice initiated a 30-day public comment period which would
have closed on March 12, 2001. In the February 9 public notice,
OEHHA announced that it was narrowing the proposed listing to bromate
rather than "bromate ion and its water soluble salts"
as originally proposed in a public notice published in the CRNR
on August 25, 2000 (Register 00, No.
34-Z.). Also, a more recent U.S. Environmental Protection Agency
document was added as a basis for the listing of bromate. OEHHA
has received a request from interested parties seeking an extension
of the comment period to allow for the submittal of complete and
relevant scientific information as it relates to the more specific
listing of bromate. OEHHA hereby extends the public comment period
to 5 p.m., Wednesday, April 11, 2001.
