Proposition 65 Law and Regulations Maximum Allowable Dose Levels (MADL) for Di(n-Butyl)Phthalate (DBP)On June 29, 2007, the Office of Environmental Health Hazard Assessment (OEHHA) issued a Notice of Proposed Rulemaking announcing the proposed adoption of the Maximum Allowable Dose Level (MADL) for the chemicals Di(n-butyl)phthalate (DBP) and amend Title 27, California Code of Regulations, Section 25805 (formerly Title 22, California Code of Regulations, Section 128051). A public comment period was provided during the 45 days, commencing from the publication of the Notice of Proposed Rulemaking on June 29, 2007 until August 13, 2007. The Notice of Proposed Rulemaking also stated that a public hearing would be held only on request. No request for a public hearing was received by OEHHA. Three written comments were received by OEHHA during the 45-day comment period. On December 7, 2007, OEHHA issued a Notice of Addition of Documents and Information to the Rulemaking File and announced a 15-day comment period which closed on January 7, 2008. The Office of Administrative Law (OAL) approved the adoption of the MADL for Di(n-butyl)phthalate (DBP) and the amendment to Title 27, California Code of Regulations, Section 25805 on June 23, 2008. The regulation was filed with the Secretary of State on June 23, 2008 and became effective July 23, 2008. 1Effective June 18, 2008 all Proposition 65 regulations have moved from Title 22 to Title 27 of the California Code of Regulations (CCR). The regulations which were previously located in Title 22, sections 12000 to 14000 inclusive, are now located in Title 27 of the California Code of Regulations, sections 25000 to 27001 inclusive.
